1.  
   1. ELIGIBILITY: The Brundage Ultimate Ski Trip Sweepstakes (“Sweepstakes”) is open only to legal residents of Idaho and Washington, who are 18 years of age or older at the time of entry and who have a smart phone with an Instagram account. Employees of Swire Coca-Cola, USA (“Sponsor”) and the “Promotional Participants” (i.e., The Coca-Cola Company, Coca-Cola Bottlers, Brundage Mountain Resort (“Brundage”), LPi Communications Group Inc. (“LPi Group”) and each of their respective related parent companies, affiliates, subsidiaries, agents, advertising and promotion agencies and suppliers that are involved in the development or execution of this Sweepstakes) and each of their immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step‑brother, step-sister, half-brother, half-sister and/or spouses of each) and/or those living in the same household of each are not eligible to enter or win a prize. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void outside of USA and where prohibited by law.

    

   2. AGREEMENT TO OFFICIAL RULES: By participating in this Promotion, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Promotion.

    

   3. TIMING: The Promotion begins at 12:00:00 a.m. Mountain Time (“MT”) on 2/22/2023 and ends at 11:59:59 p.m. MT on 3/03/2023 (“Promotion Period”).

    

   4. TO ENTER: During the Promotion Period, using your smart phone, follow the links and instructions to follow @brundagemtn on Instagram (if you are not already a follower). Then, locate the Sweepstakes Announcement Post (“Post”), (1) “like” the Post, (2) “comment” on the Post, and (3) “share” the Post to the Submission Account’s Instagram Story. The combination of these actions will henceforth be referred to as your submission (“Submission”) for a chance to win a prize. By creating a Submission, you agree that it conforms to the guidelines and content restrictions below and that Sponsor, in its sole discretion, may remove your Submission and disqualify you from the Contest if it believes your Submission fails to conform. Your mobile device carrier’s data rates apply.

    

   Guidelines:

   • The Submission account must be following the @brundagemtn Instagram account;
   • The Submission account must like Post;
   • The Submission account must comment on the Post;
   • The Submission account must share the Post to the Submission Account’s Instagram Story; and
   • The Submission must be published to Instagram

    

   Content Restrictions:

   • The Submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
   • The Submission must not disparage Sponsor, Administrator or any other person or party affiliated with the Contest;
   • The Submission must not contain images or artwork not created by entrant;
   • The Submission must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous;
   • The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
   • The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any province where Submission is created.

    

    

   Limit: Limit of one entry per person per email per day. Publicly sharing a Submission constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, transferable, assignable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Submission or any portion thereof. Sponsor is not responsible for lost, late, incomplete, invalid, un-intelligible or misdirected Submissions, which are disqualified in Sponsor’s sole discretion.

    

   In the event of a dispute as to the owner of any Submission, the authorized account holder of the account used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an account by Instagram. Each entrant may be required to show proof of being the authorized account holder.

   5. RANDOM DRAWING/WINNER NOTIFICATION: One (1) potential winner will be selected in a random drawing held on or about 3/04/2023 from among all eligible entries received. Odds of winning depend on the number of eligible entries received. Potential winner will be notified via a private message, or a comment on Instagram. The potential winner will have 48 hours of receipt of message to respond, as directed, and to provide the contact information required by Sponsor or forfeit the prize. If a potential prize winner cannot be contacted, or they do not respond by designated deadline or if Sponsor is unable to leave a message, or if any prize/prize notification is returned as undeliverable such potential winner will be automatically disqualified and an alternate potential winner may be selected.

    

   GRAND PRIZES & APPROXIMATE RETAIL VALUE (“ARV”):

    

   GRAND PRIZE: The Grand Prize is four (4) lift tickets to Brundage Mountain Resort, one (1) night standard hotel accommodations (based on double occupancy) at a hotel located in McCall Idaho and one (1) gift basket that includes, a blanket, a speaker, a mug set, a scarf set, wireless earbuds, and a travel mug set. The ARV of the Grand Prize is $600.00 USD

    

   Tickets must be used at the resort during the 2022/2023 season, and are subject to the terms and conditions of the venue. Some restrictions and blackout dates may apply. Please visit the resort website for more details.

    

   Any difference between stated approximate retail value and actual value will not be awarded. All travel-related expenses, luggage fees, meals not specified, gratuities and incidental resort and personal expenses are the sole responsibility of the winner. It is the Prize Winner’s sole responsibility to comply with all travel and accommodation requirements, which may include, without limitation, presenting necessary identification. Sponsor is not liable for any missed prize events, opportunities or expenses incurred as a consequence of cancellation/delay or ground transportation delay. Prize Winner will be required to provide a credit card at time of accommodation check-in to cover incidentals. Winner will not receive compensation for unused portions of prize package and such unused portions will be forfeited. Prize is not redeemable or exchangeable for cash and are subject to all terms and conditions of use as established by issuers. Prize consists of only the items specifically listed as the prize. Sponsor reserves the right to substitute any portion of the prize for a different prize of equal or greater value should any portion of the advertised prize become unavailable for any reason. No substitution, cash redemption or transfer of prize by winners permitted. Prize must be accepted as awarded. All federal, state and local taxes are the sole responsibility of the winner.

    

   6. PUBLICITY: Except where prohibited, participation in the Promotion and acceptance of a prize constitutes winner’s consent for Sponsor to use winner’s name, likeness, prize information, city and state of residence for promotional purposes in any media without further consideration.

    

   7. RELEASE AND LIMITATIONS OF LIABILITY/GENERAL CONDITIONS: Except where prohibited, by participating in the Promotion, entrants agree to release and hold harmless Swire Coca-Cola USA, The Coca-Cola Company, Coca-Cola Bottlers, Brundage Mountain Resort, LPi Communications Group Inc., and their respective parents, subsidiaries, affiliates, promotional partners, prize partners, agents and agencies, and the officers, directors and employees of them (the “Released Parties”) (the “Released Parties”) from and against any claim or cause of action arising out of participation or attempt to participate in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion or incorrect announcements of any kind; (b) printing errors, technical errors related to computers, servers, providers, printers or telephone or network lines; (c) errors in the administration of the Promotion or the processing of entries; lost, late, damaged, delayed, incomplete, unintelligible or misdirected entries, entries not received by the entry deadline; (d) injury or damage to persons (including without limitation, death) or property which may be caused directly or indirectly, in whole or in part from entrant’s participation in the Promotion or receipt, use or misuse of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorney’s fees. Sponsor reserves the right to cancel or modify the Promotion if fraud, misconduct or technical failures destroy or undermine the integrity of the Promotion or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by the Sponsor in its sole discretion.  In the event of termination, a notice will be posted online and the random drawing will be conducted from among all eligible entries received prior to the time of termination. The failure of the Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, pandemic, epidemic, outbreak, terrorism, act of public enemies, or actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules. No more than the stated number of prizes will be awarded. All materials submitted become the property of the Sponsor and will not be returned.

    

   8. PRIVACY: All personal information submitted by you as part of this Promotion will be treated in accordance with Swire Coca-Cola, USA Privacy Policy available at: http://www.swirecc.com/sccprivacypolicy except as otherwise described in these Official Rules and promotion materials. By participating in this Promotion, you acknowledge and agree that all information and material, including any personal information provided in your entry materials, will be collected, used and disclosed by Sponsor and its authorized agents, representatives, and other third parties involved in the execution, administration, or hosting of this Promotion, for the purposes of administering the Promotion and prize fulfillment and may be further publicized as described above. For California residents: Through the use of third parties, Sponsor will use the supplied personal information for the purpose of this particular marketing program. The Sponsor will not retain or disclose your information for any other purpose.

    

   10. DISPUTES: Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes awarded shall be resolved individually, without resorting to any form of class action, and exclusively by the United States District Court for Salt Lake City, Utah or the appropriate Utah State Court; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Promotion, but in no event attorneys’ fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor’s in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Utah, without giving effect to any choice of law or conflict of law rules (whether of the State of Utah or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Utah.
